First charges from deadly crash filed

PRESTONSBURG — Murder was not listed among the charges against the driver of a vehicle involved in a car crash that resulted in the death of 63-year-old Brenda Montgomery that were filed last week in Floyd County District Court.

James E. Mace, 22, was the driver of the 2000 Chevrolet Malibu that crashed into Jackson resident Montgomery and her passenger, Elsie Oakley, May 15. Montgomery was transported to Highlands Regional Medical Center, where she was pronounced dead by Floyd County Coroner Greg Nelson.

Assistant County Attorney Tyler Green said Kentucky State Police is still investigating the crash, and has not given his office any indication of if or when more charges may be forthcoming.

Police officials said, at the time of the accident, Mace was fleeing from sheriff’s deputies who had spotted him and his passenger, Jonathan Crider, melting down copper at an old strip mine. Deputies reported losing track of the vehicle when they reached the main road. Moments later, Mace’s vehicle would collide head-on with Montgomery’s on Route 114.

The charges filed last week against Mace include two counts of first-degree wanton endangerment (police), receiving stolen property, first-degree fleeing or evading police, criminal trespassing, and tampering with physical evidence.

Mace is currently being held in the Floyd County Detention Center. His bond was initially set at $1 million, but was reduced to $100,000 during his arraignment Monday.

Kentucky State Police did not return calls seeking comment about the investigation into the crash.
