The City of Martin’s coffers will be a little lighter following a ruling by the Floyd County Circuit Court last week.

Circuit Court Judge John David Caudill ruled against the city of Martin on Friday after Mayor Thomasine Robinson failed to show up for a contempt of court hearing. That judgement forces the city of Martin to make good on unpaid garbage fee’s totalling $11,529.00.

County Attorney Keith Bartley says that may not be the end of it.

“This doesn’t preclude us from getting a judgement for more if we find out that they actually owe us more than what they say,” said Bartley, adding the numbers provided to the county may not be accurate based on what he called inconsistencies in the monthly recorded fees.

“I don’t understand how bills can change by more than 100 percent month to month,” said Bartley. “There is no logical reason for that.”

Bartley says that the judgement stipulates that the city turn over documents related to the fees so that the numbers can be verified.

“The judge made it clear today that if their numbers are wrong then the judgement should be be amended,” he said.

According to Bartley, the judge ordered in February for the the city of Martin to provide documentation related to garbage collection fees and begin making payments. However, Bartley says that since then, the city has made only three payments.
