Police arrest man for U.S. 23 exposure

PRESTONSBURG — A Floyd County man was arrested last Thursday, after several complaints of indecent exposure were made by local motorists traveling on U.S 23.

Jason L. Prater, 29, of Prestonsburg, was arrested Aug. 30 and charged with indecent exposure and careless driving, after police, responding to complaints, caught him with his pants down.

According to the police report, Kentucky State Police Post 9 received a complaint of a male subject traveling north in a black Chevy Colbalt on U.S. 23. The complaint stated that the operator, “was nude, masturbating, within the vehicle,” and was “clearly visible to the complainant.”

When Commercial Vehicle Enforcement officer Tommy Gearheart observed the vehicle and activated his emergency lights, Prater’s vehicle began weaving erratically within the right lane. In the police report, Gearheart says he could observe Prater trying to pull his pants up within the vehicle. Prater reportedly had covered his genitals and was zipping his pants when Geartheart walked up to the vehicle.

Prater initially denied the allegations, though a written statement was obtained from a witness. According to the police report, similar complaints with the same car have been made during the past few weeks.

Prater was lodged in the Floyd County Detention Center before posting bond.

On Thursday, Prater pleaded guilty in Floyd District Court, and was given a 90-day probated sentence and two years probation. Prater will be required to serve one year of Kentucky Alternative Probation, as well as undergo an evaluation by Mountain Comprehensive Care Center.
